This Terms and Conditions Agreement ("Agreement") is a legally binding contract between you ("Customer," "you," or "your") and Apex Vanguard Dynamics LLC ("Company," "we," "us," or "our"), the provider of the selfhostedSMTP.com service ("Service"), governing your purchase and use of our email server setup and configuration services.

1. Definitions

"Service" refers to the technical setup, configuration, and provisioning of scripts and documentation provided by selfhostedSMTP.com to configure a functional SMTP server on a customer-provided Virtual Private Server (VPS).

"Customer VPS" refers to the virtual private server, including its IP address(es), that is owned, leased, and fully controlled by the Customer.

"Customer Domain" refers to the internet domain name that is owned, registered, and fully controlled by the Customer.

"Setup" refers to the specific process guided by us to install and configure software on the Customer VPS.

2. Intellectual Property Rights and License

2.1. Ownership

All intellectual property rights, title, and interest in and to the Service, our website, and the Software, including but not limited to copyrights, trademarks, trade secrets, and any proprietary knowledge related to the setup process, are and shall remain the exclusive property of Apex Vanguard Dynamics LLC and its licensors.

2.2. Limited License

Upon successful payment, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Software solely for the purpose of configuring a single SMTP server on a single Customer VPS for your own internal business or personal communication purposes.

3. Strict Prohibition Against Reverse Engineering

3.1. Prohibition

You expressly agree that you shall not, and shall not allow any third party to:

Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, underlying ideas, algorithms, structure, or design of the Software
Modify, adapt, translate, or create derivative works based on the Software
Use the Software to develop, design, or create a competing product or service
Copy, reproduce, republish, upload, post, transmit, or distribute the Software

4. Customer Responsibilities and Acceptable Use

4.1. Zero-Tolerance for Spam

The Service is provided for the sending of legitimate, transactional, and marketing emails in full compliance with all applicable laws, including the CAN-SPAM Act. You are strictly prohibited from using the Service to:

Send unsolicited bulk email ("spam")
Send fraudulent, misleading, or malicious content
Engage in any illegal or fraudulent activities
Send emails to purchased or harvested email lists

YOU, AND YOU ALONE, ARE SOLELY AND COMPLETELY RESPONSIBLE FOR ALL EMAILS SENT FROM YOUR VPS AND DOMAIN.

5. Service Guarantee and Refund Policy

5.1. Performance Guarantee

We guarantee that the Setup provided will achieve a 10/10 score on mail-tester.com provided that the following conditions are met:

The Customer Domain is not blacklisted on any major domain blacklist
The Customer VPS's IP address is not blacklisted on any major IP blacklist
The Customer's DNS records are correctly configured as per our instructions
The test is conducted using the exact server and domain we configured

5.2. Refund Policy

A refund for the cost of the Setup is only available if we are completely unable to establish a basic functioning SMTP server on your VPS. No refunds will be issued for issues related to email content, spam complaints, blacklisting that occurs after a successful setup, or deliverability to specific providers.

6. Third-Party Services

Our payment processing for credit/debit cards is handled by Stripe, Inc. Your use of Stripe's services is governed by Stripe's own Terms of Service and Privacy Policy.

7. General Provisions

7.2. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.

7.3. Entire Agreement

This Agreement constitutes the entire agreement between you and Apex Vanguard Dynamics LLC regarding the Service and supersedes all prior agreements and understandings, whether written or oral.
